Obtaining or Transferring a Liquor License for a Golf Course

For many, it’s not uncommon to grab a drink before or after (and maybe even during) a good round of golf. In order to do this, the owner and/or operator of a golf course has to obtain a liquor license from the Pennsylvania Liquor Control Board (PLCB). Most likely, this license will be a Privately-Owned Private Golf Course Club Liquor License (PGC, GCC). The Plenary Licenses in New Jersey

Within the Intoxicating Liquors title of the New Jersey statutes, there are three plenary licenses that are available for manufacturers located within the State: the Plenary Brewery license, the Plenary Distillery license and the Plenary Winery license. These licenses are intended for the largest producers of alcoholic beverages, permitting the largest production of all manufacturers’ licenses. They are also the most costly licenses to obtain. Retirement Communities and Nursing Homes are Permitted to Sell Alcohol

It wasn’t until 2002 that a “continuing care retirement community” (CCRC) was permitted to obtain a license to serve alcoholic beverages to its residents on the retirement community’s premises. To be considered a CCRC under the Pennsylvania Liquor Code, the facility must house at least one hundred people over the age of sixty-two. Continue reading

New Residential Lease Language Required to Collect Attorneys’ Fees

On January 17, 2014, Gov. Christie signed into law Assembly Bill 3851, requiring landlords of residential property to include additional language in new residential leases after February 1, 2014. The new law recognizes an implied covenant of collection of attorneys’ fees and costs for a tenant, if the lease allows the same for the landlord. Continue reading

Third Tier Roadways within Community Associations are Entitled to Reimbursement Under Municipal Services Act

A recent trial court decision in Ocean County held that all roadways within a qualified private community – such as a homeowners association or condominium association – which provide access to units and function as roadways are eligible for reimbursement under the Municipal Services Act. PA Superior Court Relaxes Formerly Strict Circumscription of Confession of Judgment Clauses

The Pennsylvania Superior Court recently relaxed the Pennsylvania Courts’ trend of scrupulously constraining the use of warrants of attorney, also known as “confession of judgment” clauses in non-consumer credit transactions. In Graystones Bank v. Grove Estates, LP., 2012 Pa.Super. 274 (2012), affirmed at 2013 Pa. LEXIS 2855 (Pa. 2013) a debtor made a Promissory Note in favor of the creditor, which contained a warrant of attorney. After some time, the debtor began to have trouble making payments under the Note. The creditor then required the debtor to establish an interest reserve and pledge additional real property as collateral, and to enter a “Change in Terms Agreement.” The Change in Terms Agreement did not itself include a warrant of attorney.
