Stark & Stark Shareholder John Eory, member of the firm’s Divorce Group, authored the article “Parental Relocation Reconsidered,” which was published on June 8, 2015, by the New Jersey Law Journal.
The article discusses the case of Baures v. Lewis and the issue of parental relocation in New Jersey. Parental relocation is a tricky matter because it “involves the tension between a custodial parent’s need or desire to relocate and the other parent’s right to maintain a meaningful relationship with his or her children.” Baures has long been the accepted law when dealing with parental relocation until recently, when the “Family Law Executive Committee of the New Jersey State Bar Association appointed a special committee to examine the relocation law.” This new committee proposed a statute to replace Baures and focus more on what is in the best interest of the child.
Mr. Eory said, “The time has come for the best interests of the child to assume its rightful place as the focal point of legal advocacy and judicial determination in relocation cases.”
