David’s client was 83 years old when he was rear-ended by a tractor trailer and severely injured. For three months, he suffered terribly and ultimately passed away due to his injuries. The estate of the client was represented by Stark & Stark Shareholder David Schmid and Associate Bhaveen Jani.
The insurance company covering the tractor trailer company took the position that the value of the case was diminished as David’s client statistically had only about a 3 year life expectancy at the time of the crash. In response, David presented a time unit formula to emphasize the profound suffering that his client tragically experienced in the last 3 months of his life.
