What is Valsartan?
Valsartan is part of a class of drugs, including Losartan and Irbesartan, that are used to treat heart failure, high blood pressure, and certain effects of diabetes. These drugs have been in use for several decades under trade names including Diovan (Valsartan), Cozaar (Losartan) and Avapro (Irbesartan). Valsartan drugs are now available in the United States as the active ingredients of several generic drugs. Accordingly, Valsartan medications are widely manufactured overseas in such countries as China and India. Unfortunately, the Federal Drug Administration (FDA) has found that extensive amounts of the Valsartan drugs made by generic manufacturers contain nitrosamine impurities such as N-Nitrosodimethylamine (NDMA), and N-Nitrosodiethylamine (NDEA). It is believed that those impurities may have the potential to cause cancer and/or serious liver damage, prompting widespread recalls published by the FDA.
Do I Have a Claim? What are Valsartan Side-Effects?
Recent lawsuits claim that Valsartan drugs may have been tainted with potentially cancer causing impurities as far back as 2012. Not all Valsartan drugs are tainted or contaminated. Patients being treated with possibly tainted Valsartan medications should have received notice in or around July 2018, regarding whether the lots of Valsartan drugs involved in their treatment were involved in the pending recalls. If you or a loved one was taking Valsartan drugs on the list of potentially tainted lots and have suffered one or more of the following injuries or side-effects, you may be entitled to compensation.
- Liver Cancer
- Liver Damage
- Colorectal Cancer
- Kidney Cancer
- Kidney Damage
- Gastric Cancer
Have Valsartan Recall Lawsuits Been Filed in Pennsylvania?
Numerous lawsuits across the nation have been filed against the entities involved in the manufacturing processes that yielded allegedly tainted Valsartan drugs. Those entities include Zhejiang Huahai Pharmaceutical, Prinston Pharmaceutical, Solco Healthcare, Huahai, Hetero Labs, Camber Pharmaceuticals, Torrent Pharmaceuticals, Major Pharmaceutical, Solco Healthcare, and Teva Pharmaceutical. Further, ongoing FDA investigations have broadened to alleged industry-wide issues.
These lawsuits are being brought by individuals and classes of plaintiffs based upon: economic damages from purchasing the recalled drugs; personal injury damages from cancer or severe liver damage caused by the recalled contaminated drugs; and economic damages from insurers and other third-parties that paid for the recalled drugs. Plaintiffs allege that the defendants knew, or should have known, of the Valsartan impurities as early as 2012, and obviously should have warned patients – and their doctors – of the dangers. All of these claims have been consolidated into a Multi-District Litigation (MDL), which centralizes pretrial activities for multiple cases to save time, court costs, and attorneys’ fees.
Accordingly, all of the federal nationwide Valsartan claims are now consolidated in the United States District Court, District of New Jersey, in In re: Valsartan Products Liability Litigation, MDL No. 2875, before Judge Robert B Kugler, U.S.D.J.
